The Government has issued a new Decree detailing salary and allowance policies for individuals who are assigned or mobilized to perform duties during a state of emergency.

The Government has issued Decree No. 190/2026, detailing the implementation of several provisions of the Law on the State of Emergency. The decree clearly stipulates salary, allowance, and support policies for organizations and individuals assigned or mobilized by competent authorities to participate in activities during a state of emergency. The decree will officially take effect on July 13, 2026.
Under the new regulations, personnel whose salaries are funded by the state budget and who are assigned to perform duties during a state of emergency will continue to receive their full salaries according to their rank, grade, military or police rank, and position from their original employing agencies or organizations. Position allowances, seniority allowances, regional allowances, and other lawful allowances will also remain unchanged throughout the assignment period.
In addition to their regular salaries, these personnel will receive daily hazardous-duty allowances at three levels:
Level 1: Equal to 0.2 times the statutory base salary per day for duties performed during a standard state of emergency.
Level 2: Equal to 0.3 times the statutory base salary per day for duties carried out in areas exposed to hazardous conditions or locations severely affected by natural disasters, epidemics, or major incidents.
Level 3: Equal to 0.4 times the statutory base salary per day for particularly hazardous duties posing a high risk to life and health.
Furthermore, civil servants, public employees, and workers performing overtime duties at Emergency Steering Committees, Command Centers, or Standing Offices will be entitled to overtime pay in accordance with current Government regulations guiding the implementation of the Labor Code.
During the mobilization period, individuals who do not receive salaries from the state budget will be entitled to daily labor allowances and meal allowances equivalent to those granted to members of the Self-Defense Militia Force when assigned to official duties under current regulations.
Those required to work at night—from 10:00 p.m. to 6:00 a.m.—will receive an additional labor allowance of at least 50% above the standard daily allowance.
The decree also establishes additional daily allowances based on hazardous working conditions:
Level 1: An additional amount equal to 0.5 times the standard daily labor allowance for duties performed during a state of emergency.
Level 2: An additional amount equal to 0.7 times the standard daily labor allowance for work in disaster-stricken, epidemic-affected, or otherwise hazardous areas.
Level 3: An additional amount equal to 1.0 times the standard daily labor allowance for exceptionally dangerous work threatening life and health.
For employees working in enterprises or organizations outside the state payroll system, the mobilizing authority is responsible for paying daily allowances, meal allowances, and additional hazard-related benefits. At the same time, the employer must continue paying wages during the employee’s absence at a level no lower than the regional minimum wage prescribed by the Government at that time. These expenses may be accounted for as legitimate business management costs.
The Government authorizes ministers responsible for relevant sectors to determine specific classifications of hazardous, dangerous, or exceptionally dangerous conditions where existing laws do not provide detailed guidance. The applicable allowance level will be decided by competent authorities based on the nature of the assignment, location, risk level, and other relevant factors, and must be clearly stated in the mobilization order.
To ensure adequate living conditions for mobilized personnel, the decree stipulates that individuals assigned to locations far from their place of residence and unable to commute daily must be provided with accommodation, meals, transportation support, or reimbursement for one round-trip journey, under standards similar to those applied to commune-level officials and civil servants.
For personnel receiving state-funded salaries who perform night-duty shifts (from 10:00 p.m. to 6:00 a.m.), additional meal allowances will be provided as follows:
Level 1 (from 2 hours to less than 4 hours of night duty): An additional meal allowance equal to 0.5 times the standard daily meal allowance provided to active-duty infantry non-commissioned officers and enlisted soldiers of the Vietnam People’s Army.
Level 2 (4 hours or more of night duty): An additional meal allowance equal to 1.0 times the standard daily meal allowance provided to active-duty infantry non-commissioned officers and enlisted soldiers.
Funding for salaries, wages, allowances, and support payments under the decree will be covered by the state budget according to the principle that the authority issuing the mobilization order is responsible for the corresponding expenditures.
All payments must be made transparently, publicly, and accurately based on the actual time each individual spends performing assigned duties. Where a person qualifies for multiple allowances or benefits simultaneously, the highest applicable rate will be applied to ensure maximum protection of their rights and interests.
