The Government has just issued Decree No. 123, detailing certain provisions of the law on inland waterway traffic and the law amending and supplementing certain provisions of the law on inland waterway traffic.

This Decree includes facilities for new construction, modification, repair, and restoration of marine vehicles; transport of oversized and overweight cargo.
This Decree applies to organizations and individuals involved in the activities of new construction, modification, repair, and restoration of marine vehicles, as well as transport of oversized cargo and overweight cargo.
Oversized/ overweight cargo transport plan
Regarding the transport of oversized and overweight cargo, the Decree stipulates as follows:
Oversized cargo refers to non-demountable cargo with dimensions where the total length > 40 m or width > 10 m or height > 4.5 m.
Overweight cargo refers to non-demountable cargo with a total weight > 100 tons.
Before carrying out the transport of oversized or overweight cargo, the vessel master, transporter, or transport business operator must prepare an oversized and overweight cargo transport plan and submit it to the competent authority for approval.
The Decree stipulates the authority to approve oversized/ overweight cargo transport plans as follows:
The Vietnam Maritime and Waterway Administration conducts the approval of oversized/ overweight cargo transport plans in the following cases: vessels departing from seaports; vessels departing from inland ports or wharves with inter-provincial transport routes.
The Department of Construction conducts the approval of oversized/ overweight cargo transport plans in cases where vessels depart from inland ports or wharves with intra-provincial transport routes.
In addition, the Decree also stipulates that facilities for new construction, modification, repair, and restoration of marine vehicles must meet the requirements on firefighting, safety, occupational hygiene, and environmental protection as prescribed.
This Decree takes effect from July 1, 2026.
