After the National Assembly passed Resolution 254/2025, the Government issued Decree 50/2026 to address bottlenecks arising in the implementation of the Land Law 2024.

From 2026, households and individuals converting agricultural land to residential land within the prescribed quota will be required to pay only 30% -50% of the difference between residential and agricultural land prices.

One notable content is the change in calculating land use fees for households and individuals when converting from agricultural land to residential land. Previously, residents had to pay 100% of the difference between residential and agricultural land prices. Under the new regulations, the collection rate is divided based on the area within and exceeding the residential land allocation quota.

The area within the quota only requires 30% of the difference; the area exceeding the quota but not more than one quota requires 50%; while the area exceeding one quota still applies 100%. This policy is implemented once for each household or individual on one land plot.

For cases approved for land use purpose conversion from August 1, 2024, to before January 1, 2026, residents can request recalculation of land use fees under the new regulations. If financial obligations have been completed, the difference will be refunded or deducted, provided the application is submitted before January 1, 2027.
