New Party regulations issued for state-owned enterprises and economic groups

The Party Secretariat has issued Regulation No. 196 on the organization and operation of Party organizations within state-owned economic groups, corporations, companies, and commercial banks.

On behalf of the Party Secretariat, Mr. Tran Cam Tu, Politburo member and Standing Member of the Secretariat, signed and promulgated Regulation No. 196 dated June 10, 2026, on Party organizations in economic groups, corporations, companies, and state-owned commercial banks.

Regulation No. 196 stipulates that Party organizations in economic groups, corporations, companies, state-owned commercial banks, financial institutions, and enterprises in which the State holds 100% of charter capital or controlling shares and capital contributions (collectively referred to as state-owned enterprises in this Regulation) shall be affiliated with the Party committees of ministries or ministerial-level agencies (excluding Party organizations in state-owned enterprises managed by the Ministry of Public Security and the Ministry of National Defense). Special cases shall be decided by the Politburo and the Party Secretariat.

For Party organizations under local Party authorities (Party committees of communes, wards, special zones where the enterprise is headquartered, Party committees of provincial or municipal People's Committees, or provincial and municipal Party Committees), two organizational models may be established: a Party Committee covering the entire enterprise and a Party Committee of the parent company.

Conditions for establishing a Party Committee covering the entire enterprise

According to the Regulation, a Party Committee covering the entire enterprise may be established under a ministry or ministerial-level agency Party Committee for state-owned enterprises established or approved by the Prime Minister and holding an important position in socio-economic development, national defense, and security.

In addition, the operations of member units and the state-owned enterprise must be closely integrated. Member units must either operate under dependent accounting arrangements or be largely dependent on the parent company in terms of technology, technical expertise, finance, markets, key products, and services.

Member units may be located across multiple localities but must not significantly influence local political tasks or socio-economic development objectives. Special cases shall be decided by the Politburo and the Party Secretariat.

A Party Committee covering the entire enterprise may also be established under local Party authorities for state-owned enterprises established by provincial or municipal People's Committees or by ministries and central agencies.

In such cases, the operations of member units and the enterprise must likewise be closely integrated, with member units operating under dependent accounting arrangements or relying substantially on the parent corporation or company for technology, technical expertise, finance, markets, key products, and services.

Member units may be located in multiple communes, wards, or special administrative zones both within and outside a province or city, provided they do not significantly influence local political responsibilities or socio-economic development.

Conditions for establishing a parent company Party Committee

A Parent Company Party Committee under a ministry or ministerial-level agency Party Committee includes Party organizations in departments, divisions, companies, and units located at headquarters; branches (excluding bank branches); representative offices operating under dependent accounting arrangements; Party organizations in enterprises and member units headquartered in the same province or city as the parent company's headquarters; and Party organizations in key member units that play a strategic role within the enterprise, even if they are located outside the province or city where the headquarters is based.

Special cases shall be decided by the Politburo and the Party Secretariat.

The remaining grassroots Party committees and Party cells in member units of state-owned enterprises shall be affiliated with the Party authorities of the commune, ward, special zone, or the Party Committee of the provincial or municipal People's Committee where the member unit is headquartered.

Regulation No. 196 also stipulates that for Party organizations in state-owned enterprises whose immediate superior Party authority is a provincial, municipal, or centrally affiliated Party Committee but which do not yet meet the conditions for establishing an upper-level grassroots Party Committee, the provincial-level Party authority may decide to establish a grassroots Party Committee after obtaining written approval from the Central Organization Commission.

The Party Committee of a state-owned enterprise shall take the lead in coordinating with local Party authorities where member units are located to direct Party organizations in carrying out production and business activities as well as personnel work. It shall also coordinate with local Party authorities in Party-building activities and the operation of socio-political organizations in accordance with the coordination regulations issued by the Party Secretariat.

On the same day, Standing Member of the Secretariat Tran Cam Tu also signed Decision No. 197, issuing regulations on coordination between Party committees of economic groups, corporations, companies, and state-owned commercial banks and local Party authorities.

According to the decision, coordination activities must ensure the continued strengthening of the Party’s leadership role; reinforce the centralized and unified leadership of Party committees within state-owned enterprises in production, business operations, and personnel management; and uphold the leadership and direction of local Party authorities in Party-building work and the activities of socio-political organizations.
